A complainant may file a complaint with or without the assistance of a private attorney. The Intake Department handles each complaint inquiry or filing in the same manner regardless of whether the complainant is represented by a private attorney. Much like the intake level, the investigative process is not influenced by representation by a private attorney. The KHRC will not advise a client to go to a specific attorney to seek help. The Kansas Bar Association (KBA) has a free lawyer referral service that will assist in the selection of an attorney. It is not necessary, or required for a complainant to have legal help outside of the KHRC. It is the option of the complainant as to whether they wish to retain private, outside legal counsel.

No legal representation is furnished by the KHRC. Once the Commission has determined that "probable cause" exists and the case fails to conciliate then the KHRC legal staff will present the case in support of the complaint during the public hearing process. Complainants may be represented by private counsel if they so choose, during the public hearing process.

If a complainant chooses to have outside legal representation then it is his or her duty to contact an attorney. KHRC does not recommend specific lawyers to parties to complaints pending with KHRC. One source for contacting attorneys to represent parties to complaints before KHRC is the KBA's lawyer referral service at 785-234-5696.
